The new milestone comes as CanAm commemorates the 20^th year of partnership with the Philadelphia Industrial Development Corporation (PIDC). CanAm and PIDC formed the first Regional Center - CanAm PIDC Regional Center - in Philadelphia. Here are 3 things you should know about the litigation, and what the settlement terms mean to you as an EB-5 investor.

The suits were filed to keep EB-5 regional centers in operation. In March of 2022, the U.S. President signed into law the EB-5 Reform and Integrity Act of 2022 (RIA), which reinstated and reformed the EB-5 Regional Center Program (The program had lapsed in June of 2021 after its previous authorization expired in 2021). While this news was welcomed, about one month later, USCIS posted a notice to its website announcing that all existing EB-5 regional centers were no longer authorized and would need to re-apply for reauthorization. This announcement impacted over 600 approved EB-5 regional centers, including CanAm’s - an industry leader for immigration-linked investments for 35 years. With more than 90% of EB-5 investors choosing to invest with an EB-5 regional center, USCIS’s announcement put new EB-5 investments in doubt and cast uncertainty over the ability of EB-5 regional center operators to serve the needs of their immigrant investors, who were supposed to be protected by the “grandfathering” provisions in the RIA. So, in May of this year, CanAm joined other leading EB-5 regional operators to challenge the USCIS’s actions in the U.S. District Court for the Northern District of California.

The EB-5 regional center program was not interrupted. Although USCIS announced that all existing EB-5 regional centers were deauthorized after the new EB-5 law was passed in March, USCIS did resume processing green card applications filed by EB-5 investors. Further, in June of 2022, the Federal Court blocked USCIS from unilaterally deauthorizing existing EB-5 regional centers, which allowed CanAm and other regional center operators to continue to pursue EB-5 projects.

The EB-5 settlement agreement speeds up the ability to file investor petitions - In September 2022, the Federal Court approved a settlement agreement between CanAm and its co-plaintiffs and USCIS. The USCIS has agreed that previously authorized EB-5 regional centers can retain their authorization but must file a new application (Form I-956) to establish their eligibility under the RIA by December 29, 2022. USCIS also agreed that EB-5 regional centers can immediately proceed to file applications seeking approval of their EB-5 projects (Form I-956F), and if, after filing a Form I-956F, a formal receipt notice is not issued within ten (10) calendar days following delivery to USCIS, EB-5 investors may use other forms of proof of the Form I-956F filing in order to file their related EB-5 petitions (Form I-526E), such as a lock box receipt and a cashed check or credit card charge for the filing fee.

The project site is strategically located in Eastern Texas with close proximity to large industrial hydrogen end-users as well as access to reliable power and superior logistics including rail, marine and existing pipelines that span the U.S. Gulf Coast region.
 

The planned green hydrogen gas production plant will supply nearby industrial customers in one of North America’s largest petrochemical refinery hubs with the environmentally friendly product. Due to come on-line by mid-2024, the shovel-ready, ground-up construction located in a Targeted Employment Area (TEA) is expected to generate more than enough qualifying jobs to satisfy EB-5 Program requirements.

Perhaps the biggest indication of Canada’s resounding commitment towards immigrants, even regardless of the special immigration and travel restrictions in place, is that both the federal government and Canadian provinces continue to hold immigration draws to invite more people to submit their applications for Canadian permanent residence.

Despite the fact that Canada’s immigration policies and procedures have undergone major changes since March 18, the popular federal Express Entry system has remained fully operational. Although there may be some delays in the visa application processing times, the Canadian visa application process is still open to skilled foreign worker and international students who want to begin a new life in Canada.

Immigration, Refugees and Citizenship Canada (IRCC) has also announced various temporary measures to help applicants who are not able to submit their complete documentation due to coronavirus-related disruptions. Applicants are granted extra time to submit supporting documentation as long as they can provide proof that they were unable to attain due to being restricted to do so.

In order to offer more flexibility and help foreign nationals enter Canada during coronavirus pandemic, IRCC has also put in place a temporary policy measure to exempt temporary foreign workers who are set to work as truck drivers, or in the Health-Care, Agriculture or Agri-food sectors in Canada from having to give their biometrics before arriving in Canada if the biometrics collection site closest to them is closed due to a coronavirus-related disruption.

The Canadian government has carried out special measures affecting international students during the coronavirus pandemic. They are now allowed to pursue their studies online and remain eligible for a Post-Graduation Work Permit and eventually for Canadian permanent residence.

Usually, Canada immigration does not count online courses toward the study requirement for a PGWP application. However, due to Canada’s coronavirus travel restrictions, IRCC reformed this rule & announced that International students will not have time deducted from the length of their PGWP for the period they spent outside of Canada, up to December 31, 2020.

The Government of Canada has also temporarily removed restrictions on off-campus work for certain international students. International students working in an essential service such as in health care, critical infrastructure or the supply of food and other critical goods are currently allowed to work more than 20 hours per week, while their classes are in session.

Effective from June 8, 2020, Canada also allowed immediate family members of Canadian citizens or permanent residents Spouse or common-law partner, Dependent children, Parent or step-parent, and Guardian or tutor to enter Canada. They will be able to enter Canada as long as the visit is at least 15 days long and they must self-quarantine by law for 14 days upon entering Canada.

IRCC has announced that it will resume the processing of Temporary Resident Visas (TRVs) submitted online as well as electronic travel authorization (eTA) applications on June 9. Applications will be processed for only those individuals who are currently eligible to travel to Canada based on current travel restrictions. These include individuals travelling to Canada for essential purposes and eligible immediate family members who intend on remaining in Canada for at least 15 days.
